Whether you are a large international corporation or a specialized smaller operation, there are options for you to move workers into Canada under the International Mobility Program (IMP), as well as under the Temporary Foreign Worker Program (TFWP).

International Mobility Program

The IMP allows for employers to hire or transfer foreign nationals from outside Canada without the need for a Labour Market Impact Assessment.  NAFTA and other international agreements fall under this category.  Employers are required to make an “Offer of Employment” and pay a “Compliance Fee” through their Employer Portal.

Temporary Foreign Worker Program

The TFWP is a way for employers to hire foreign nationals to fill a labour shortage.  This category requires that employers submit a request for a Labour Market Impact Assessment (LMIA) to Employment and Social Development Canada (ESDC).  If ESDC provides a positive assessment, then the employer may hire a foreign national for the positon approved in the LMIA.

Cautions

Both the IMP and the TFWP require that employers be responsible for maintaining the terms of employment of the Offer of Employment/LMIA.  Employers of both categories may be contacted by either ESDC or IRCC (Case Management Branch) for a Compliance Review.  It is the responsibility of the employer to maintain all records for six years from the date of the LMIA request to ESDC or the date the Offer of Employment is submitted.
